How to handle a workplace accident

Under French Labor law, there are strict rules which need to be complied with when an employee has an accident in the workplace. Non-compliance can result in a criminal fine equal to €3,750 and an administrative fine equal to up to 15 700€ per breach. 

Work accidents can also occur outside the workplace and namely when the employee is travelling for work. Accidents travelling to and from work also need to be declared. Mental health issues can also qualify as work accidents. 

DO

- Ensure you report the work accident within 48 hours to the Health Insurance Fund (“Caisse primaire d’assurance maladie”) namely via www.net-entreprises.fr. 

- Provide the employee with an accident form (“feuille d’accident du travail”) so that they do not need to pay for medical expenses.

- Ensure you answer the questionnaire sent by the Health Insurance Fund regarding the circumstances of the work accident within 30 days.

DON'T

- Forget to inform the Labor Inspector in case of a fatal work accident within 12 hours of the employee’s death.

- Forget to write to the Health Insurance Fund within 10 days if you wish to challenge the fact that the accident was work-related (“lettre de réserves”).

- Forget to declare the work accident in your monthly declaration (“Déclaration Sociale Nominative”) to the social security and tax authorities.
